Legal fees in Poland

Our polish lawyers always apply our remuneration and all other costs objectively on the basis of the time and effort required for a specific case. We always provide our clients with clear and detailed information on costs and calculate them based on client's decision and acceptance of the mandate. For this reason we would like to help you out with this and describe financial matters of legal proceedings in Poland.

 

Pre-litigation / out-of-court representation


The term "pre-litigation" means review of the case and legal situation of the party as well as sending a request for payment to the debtor, in which we state the outstanding payment and the associated default interest, as well as the final payment deadline. Of course, we conduct the necessary correspondence with the debtor or his lawyers and exchange the arguments and the relevant reasons. At this stage, we advise clients on further necessary steps, such as notice of default, withdrawal from the contract or termination of the contract.

Lawyer fees

Lawyer fees in the Polish proceeding are determined by law and are clearly shown using following table:

Legal fees therefore always depend on the value of the dispute, with the respective amounts falling within a certain range “from-to”. Legal fees are determined in the court verdict and imposed on the losing party. This means that they are also subject of enforcement together with the main claim. Please consider however, that a Polish court will always apply Polish regulation.

Court costs
The court fee in Poland is generally 5% of the value of the dispute. For claims totalling up to PLN 20,000.00 (approx. EUR 5,000.00), a special, simplified payment order procedure can be initiated in which the following court fees are to be borne:

Similar to lawyer fees, court costs are determined in the court verdict and imposed on the losing party.


Additional costs:

Enforcement costs - the enforcement costs include down payments for the bailiff to commence his actions, especially the determination of the debtor's property and execution of seizure, as well as lawyer fee, which amounts to a quarter of the general lawyer fee;

Translation costs – all documents which shall be applied in a proceeding must be translated into Polish;

Power of attorney fee (stamp tax) - this amounts to PLN 17.00 (approx. EUR 4.00)

Travel expenses - we do not charge any additional costs for attending court appointments at our office in Szczecin. The case is different for court appointments outside of Szczecin, namely:

  • we charge EUR 50.00 net for a court appointment at which our representative will appear;
  • we charge EUR 300.00 net for a court appointment in which we appear in person, which is the case in complex cases and when non-Polish-speaking witnesses are questioned.

We are ready to consider other models for possible collaborations that may have a long-term character and that deal with a large number of cases.
